1. Who we are

AIDogPhotos is operated by Marius Vogel, sole proprietor (Einzelunternehmer),

2. Scope and acceptance

By accessing or purchasing any service at aidogphotos.com ("Service") you enter into a legally binding contract with us and accept these Terms of Service ("Terms"). If you do not agree, do not use the Service.

3. Eligibility

The Service is intended for natural persons capable of concluding contracts under the law applicable in their country of residence.
If you are under 16 you must obtain verifiable parental consent before using the Service.

4. How the Service works

• You upload a digital photo of your dog ("Upload").
• Our system generates an AI-rendered portrait ("Output") and sends you a download link by email.
• Uploads are processed in memory only and are not stored. Outputs are retained for 90 days so you can re-download them.
• We do not use Uploads or Outputs to train or fine-tune any machine-learning model.

5. Prices & payment

• The Service is sold once-off at the price displayed at checkout; all consumer-applicable taxes are included unless stated otherwise.
• Payments are processed by Lemon Squeezy, Inc. (USA). Your card or payment data is handled exclusively by Lemon Squeezy.

6. Digital-content withdrawal notice & goodwill re-generation guarantee

Under §§ 312f, 356 Abs. 5 BGB you lose your 14-day statutory right of withdrawal once (i) you explicitly request immediate performance and (ii) we begin execution. By clicking "Pay now" you

1. expressly request us to deliver digital content during the withdrawal period; and
2. acknowledge that you thereby lose your right of withdrawal.

Goodwill 7-day re-generation guarantee. If you are not satisfied with the Output, email support@aidogphotos.com within 7 calendar days of delivery. We will manually re-generate the portrait once at no extra charge. This goodwill guarantee does not include a cash refund.

7. Licences

Uploads. You retain all rights. You grant us a non-exclusive, royalty-free, worldwide licence to use the Upload solely to provide the Service; the licence ends when the Upload is deleted.

Outputs. You receive all IP rights in the Output that can be granted. We impose no further restrictions.

8. Prohibited conduct

You must not use the Service to create or distribute content that is illegal, defamatory, obscene, or infringes third-party rights. We may suspend access if you breach this clause.

9. Intellectual property in the Service

All software, design, text and graphics on aidogphotos.com are our property or licensed to us. You may not copy or reverse-engineer the Service.

10. Availability and changes

The Service is provided "as is". We may modify or discontinue features at any time and will try to notify paying customers of material changes.

11. Disclaimer of warranties

Except as required by law, we give no warranties—express or implied—regarding fitness for a particular purpose or non-infringement.

12. Limitation of liability

• Unlimited liability for intent, gross negligence or injury to life, body or health.
• For slight negligence we are liable only for breach of a material obligation and then only for foreseeable damage.
• Product-liability claims remain unaffected.

13. Indemnification

You will indemnify us against claims arising from your breach of these Terms or infringement through your Uploads or Outputs.

14. Governing law and venue

German law applies. Exclusive venue: Local Court Minden, Germany (unless consumer rules mandate otherwise). EU-ODR platform: link. We do not take part in ADR before a consumer arbitration board (§ 36 VSBG).

15. Notices and takedown procedure

Send copyright notices to support@aidogphotos.com or the postal address above. Include enough detail for us to locate and assess the material.

16. Assignment

You may not assign this contract without our consent. We may assign it in a business transfer.

17. Severability

If any provision is invalid, the rest remains in effect.

18. Changes to these Terms

We may update these Terms for legal or operational reasons. If a change is material and you have an active, unfulfilled order, we will notify you by email. Continuing to use the Service after the effective date constitutes acceptance.
